Legal notice
Welcome to Suniori (suniori.com). We respect the intellectual property rights of creators, artists, and designers, and we expect our users and partners to do the same.
This Intellectual Property and DMCA Policy outlines how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and general intellectual property laws.
1. Our Commitment to Intellectual Property
Suniori operates as a Print-on-Demand (POD) e-commerce platform. Our product designs are curated, created internally, or sourced through authorized licensing agreements with independent creators and asset providers. We strictly prohibit the unauthorized use of copyrighted artwork, trademarked phrases, logos, or brand names on our products.
If you believe that your intellectual property rights have been violated by content appearing on suniori.com, we encourage you to notify us immediately following the procedures detailed below.
2. Notice of Copyright Infringement (DMCA Notice)
If you are a copyright owner or an authorized agent thereof and believe that any content or product design on suniori.com infringes upon your copyright, you may submit a formal notification pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512(c)).
To be effective, your DMCA Takedown Notice must be submitted in writing to our designated agent at support@suniori.com and must include the following information:
-
A Physical or Electronic Signature: The signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
-
Identification of the Copyrighted Work: A clear description of the copyrighted work that you claim has been infringed (e.g., a link to your original artwork, registration numbers, or a detailed description of the design).
-
Identification of the Infringing Material: Specific identification of the material/product on suniori.com that you claim is infringing, including the direct URL(s) to the specific product page(s).
-
Contact Information: Information reasonably sufficient to permit Suniori to contact you, such as your full legal name, physical address, telephone number, and email address.
-
Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
-
Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
3. How Suniori Responds to Claims
Upon receipt of a valid, fully compliant DMCA Notice, Suniori will act expeditiously to:
-
Remove or disable access to the allegedly infringing product or design.
-
Notify the relevant supplier, designer, or partner associated with the product regarding the removal.
-
Maintain a record of the notice and action taken as part of our compliance protocols.
4. Counter-Notification Procedures
If a product or design you provided was removed or disabled as a result of a DMCA Notice and you believe this action was the result of a mistake or misidentification, you may submit a Counter-Notification.
To be valid, your Counter-Notification must be sent in writing to support@suniori.com and must include:
-
Your physical or electronic signature.
-
Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed.
-
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
-
Your name, physical address, and telephone number.
-
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you reside outside of the United States, that you consent to the jurisdiction of the United States District Court for any judicial district in which suniori.com may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
If a valid Counter-Notification is received, Suniori may send a copy to the original complaining party informing them that the removed material may be replaced or access restored in 10 to 14 business days, unless the copyright owner files an action seeking a court order against the alleged infringer.
5. Trademark Infringement
This policy also applies to the unauthorized use of trademarks. If you believe your registered trademark (such as a brand name, slogan, or logo) is being used on suniori.com in a way that causes consumer confusion or dilution of your mark, please contact us at info@suniori.com with:
-
The registered trademark registration number and country of registration.
-
A description of the goods/services covered by the registration.
-
The specific URLs on suniori.com where the alleged trademark violation occurs.
6. Repeat Infringer Policy
In accordance with standard e-commerce protocols and the DMCA, Suniori maintains a strict policy concerning repeat infringers. We reserve the right to terminate relationships with any third-party designers, suppliers, or user accounts who are repeatedly flagged for intellectual property violations.
